Towards a Doctrine of Mobility as a Human Right
Discussion centers on mobility as a human right for all people, including the disabled. Section 504 of the Rehabilitation Act, enacted in the United States in 1973, is examined in detail. Rules published in 1979 regarding federal financial assistance program regulation guidelines for local transportation operations, including vehicle modifications, are detailed. The legislative process is described and comparisons between Canada and the United States are drawn. Public reaction and financial considerations are given. A judicial history regarding transportation equality for the handicapped is provided.
