The VII program is aimed at providing a nationwide communications network in the USA by placing devices on roads and in vehicles to exchange data between vehicles and the roadside. This article describes the legal issues associated with VII deployment. The most significant issue is privacy. The VII program will need to ensure that collected data, which includes personal identifiers, is protected from public disclosure. The regulatory requirements associated with being classified as a telecommunications carrier under the federal Communications Assistance for Law Enforcement Act (CALEA) are considered. A second issue is liability. Liability for an accident could arise if there was an error in the data that caused or contributed to an accident. Further issues with legal implications are organisational issues and anti-trust.
