Product approval procedures in transport infrastructure construction

As the Finnish Parliament approved the Act on construction product approval (230/2003), it required that Ministries swiftly examine how the approval procedure referred to in the Act could be applied in the field of construction within the Ministries' sectors. This working group examined the construction of municipal streets, public areas and infrastructure. It also analysed the construction of transport infrastructure maintained by the state. The group received comments and statements from representatives of the construction and building industry, Ministries and infrastructure maintenance as well as owners of infrastructure that is located near transport routes. Many representatives were in favour of the alternative that the Ministry of the Environment would act as the Ministry responsible for road construction. The working group made the following proposals concerning the infrastructure maintained by the state. They all call for legislative regulation: 1) CE marking system should cover products used in infrastructure construction. The notification procedure of notified bodies should also be agreed upon. 2) Infrastructure administrations or the authorities supervising traffic and infrastructure safety should be authorised to issue regulations on infrastructure construction. 3) National product approval systems could also be applicable. Provisions are needed on national approval procedures and market supervision on approved construction products. 4) Market supervision in accordance with the CE marking system as referred to in sections 181 through 183 in the Land Use and Building Act should also cover CE-marked products used in infrastructure construction. As to the construction of roads, public areas and municipal infrastructure, the approval procedures will be included in the scopes of the Act and Decree on construction product approval. The matter will be separately examined in cooperation with municipalities and the Ministry of the Environment.
