BUS DRIVERS NEEDING LEAVE? NEW DEVELOPMENTS UNDER THE FAMILY AND MEDICAL LEAVE ACT IMPACTING THE TRANSIT INDUSTRY

The Family and Medical Leave Act (FMLA), enacted 8 years ago, enables eligible employees to take up to 12 weeks of leave for qualifying conditions without the risk of losing their position. The paper looks at the impact of the law on the transit industry that has a large percentage of its employees working in operator and service capacities to the public, which makes the industry less able to absorb employee vacancies than are companies predominantly serving the private community.
