RAIL ACCESS IN THE 21ST CENTURY: A SHIPPER ATTORNEY'S PERSPECTIVE
The paper briefly discusses what is meant by "rail access", the various kinds of access and the operation of rail access in the United States where it has been recently imposed. The current state of the law that covers these different types is sketched. Followed is a brief discussion on the economic state of the rail industry and the reasons why rail competition should now be emphasized as a policy. Also discussed is how the Surface Transportation Board (STB), and, if necessary, the Congress, if the STB declines to interpret its statute broadly, can appropriately implement increased rail competition in the 21st century.
