AUTOMOBILE ACCIDENT COMPENSATION VOLUME IV: STATE RULES
Liability for automobile accidents is governed by the common law of torts, and compensation is usually paid by liability or other insurance. All states follow the common law, but each state has developed its own interpretation of that law, and many have modified its provisions by statue. As a result, the states have their own unique compensation systems. Moreover, those systems are not fixed but are continually being modified; especially during the 1970s, many states made significant changes to the rules of their systems. This report explains the current rules (as of 1983) in each of the 50 states.
