GROUNDS FOR CONTRACT CLAIMS
It might be that even at the beginning of the design phase of a project, already there is a claim embryo forming. It is with this almost inevitable phenomenon in mind that the Direction des Reclamations sur Contrats (DRSC) (Contract Claims Branch) of the Ministere des Transports du Quebec (MTQ) (Quebec Department of Transport) undertook the task, in addition to regularly proposing settlements, of limiting the scope of claims by making a study of the reasons for filing claims and endeavouring to find means of making changes, profitable both to the Department and to contractors. The analysis of the reasons for filing claims lead to a description in detail not only of the responsibility of the Department but also that of the contractor. Lastly, a few practical remarks which might prove to be a certain quarantee when presenting arguments in claim cases which, fortunately or unfortunately, some claimants may not always be capable of supporting.
