THE ECONOMIC CONSEQUENCES OF MOTOR VEHICLE ACCIDENTS: LEGISLATIVE PERSPECTIVE
This paper considers a number of issues relating to the economic consequences of motor vehicle accidents as those consequences relate to the persons responsible for such accidents, the victims and the community as a whole. In particular, the paper focuses on the effect of legislation on the determination of the existence of an entitlement to an award of damages; the assessment of the quantum of damages; and liability to pay damages in cases resulting from negligent driving of motor vehicles. A comparison is made of the legislative schemes operating in each Australian jurisdiction relating to recovery of compensation for loss resulting from motor vehicle accidents and the way in which the quantum of compensation to be paid will be calculated.
