COURT SAYS ETHICAL CONCERNS NOT CAPRICIOUS
The Supreme Court of Mississippi recently ruled that the granting of a county construction project to the second-lowest bidder based on ethical concerns arising from the lowest bid was neither arbitrary nor capricious and therefore could stand. In Huey Stockstill, Inc. v. Hales, the court concluded that awarding the contract for the reconstruction of George Ford Road Bridge to Huey Stockstill, Inc., had the potential of creating suspicion among the public and reflecting unfavorably upon the county, since a former county supervisor was employed by the company as a bid estimator.
