LIABILITY AND ITS

Liability concerns may be perceived as barriers to international companies intending to market intelligent transportation systems (ITS) products in the United States or seeking to invest in American ITS infrastructure. Along with American ITS developers, they may fear that the more elaborate forms of ITS technology will never be deployed because manufacturers will be too afraid of the legal system. Such concerns are, in the author's view, not justified and ought not to be a barrier to development of and investment in ITS in the United States. ITS is not fundamentally different under liability law from existing highway and vehicle technology except in one sense: as automated driving technologies gradually take away from the drivers' command a certain number of functions, the burden of liability will shift from the drivers to the manufacturers or operators of those technologies.
