THE DEVELOPMENT OF A PRIVACY CODE OF PRACTICE FOR ELECTRONIC TOLL SYSTEM OPERATORS IN AUSTRALIA

Electronic toll collection (ETC) systems will be utilised on a number of Australian toll roads and parking stations before the end of the decade. Questions have been raised concerning the protection of privacy for individuals electing to use this form of payment in settlement of toll and parking charges, ever since the use of electronic toll collection was first proposed. This paper will: (1) provide a brief overview of Australian privacy environment and the development of the Australian ITS Privacy Principles, from sources such as the New Zealand Privacy Act and the OECD guidelines; (2) identify the issues affecting personal privacy in the operation of ETC systems for both tollways and parking; (3) relate the issues identified to the Australian ITS Privacy Principles; and (4) outline a set of specific recommendations for the operators of ETC systems that will assist them to protect the personal privacy of their customers.
