COUNTY'S IMMUNITY FOR INJURIES CAUSED BY POTHOLE AFFIRMED UNDER TENNESSEE'S TORT LIABILITY ACT
A motorist who suffered injuries when his truck ran off the road after encountering a pothole sued Tipton County, Tennessee, for negligent maintenance. The Tipton County Circuit Court granted the county summary judgment. Finding no evidence the county had actual or constructive knowledge of the pothole, the Court of Appeals of Tennessee Western Section at Jackson affirmed the trial court's judgment.
