PUBLIC TRANSIT-RELATED ADA CASE LAW
With only a few cases being reported, the past year has been one of relative quiet for the public transit industry with respect to Americans with Disabilities Act (ADA) litigation. Two cases involved wrangling over the enforcement of settlement agreements in previously litigated ADA suits. Another ended with the adoption of a court-approved settlement after about four years of ongoing mediation and discussions. It thus appears that transit systems are, for the most part, in compliance with the ADA or making sufficient progress towards compliance that they are avoiding litigation. This article focuses on the public services benefit and program requirements of transit agencies under Title II of the Americans with Disabilities Act of 1990, 42 U.S.C, para. 12101 et seq.
