SEPARATION OF INFRASTRUCTURE AND OPERATION OF RAILWAYS IN EUROPE - INSTITUTIONAL CONSEQUENCES ON THE INTERNATIONAL LEVEL
In the 1990s most European public railway industries are undergoing comprehensive structural reforms. The creation of the European internal market and progress in the development of a European competition policy have been significant factors in the establishment of a common pattern of railway reform in Europe. This takes the form of the separation of the railway infrastructure administration from the operation of transport services. The paper assesses the institutional consequences of the separation of infrastructure and operation of the railways as a Pan-European phenomenon. The consequences are twofold. First, the role of the EU-Commission is changing. As part of the creeping competences of the EC, we are observing a gradual movement of infrastructure competences from the national to the EU institutional level. This represents a movement from the traditional focus on regulation to a more distributive policy on the European level. Second, the separation of infrastructure and operation changes the logic of international interest representation in the railway sector. In the former regime, interests of the national public railway industries have been looked after by the Community of European Railways (CER) at the EU level and at the international level by the Union Internationale des Chemins de Fer (UIC). This paper argues that the structure of interest representation will split into separate organisations on each of these levels, the first of which will be formed by the infrastructure companies, while the second grouping will be composed of the railway operators.
