IN DEFENSE OF ANTITRUST IMMUNITY FOR COLLECTIVE RATEMAKING: LIFE AFTER THE ICC TERMINATION ACT OF 1995
During the fall of 1995, members of Congress bent on deregulation finally brought down one of their most sought-after targets, the Interstate Commerce Commission, through the passage of the ICC Termination Act of 1995. Despite the efforts of some to destroy collective ratemaking through this legislation, transportation marketplace actors who benefit from collective ratemaking staved off yet another attack, convincing the Congress that the system has enormous value and must be maintained. Part of the debate surrounding collective ratemaking involves the conflicting marketplace visions that exist for trucking.
