SHARED RESOURCE PROJECTS: TRADING PUBLIC HIGHWAY RIGHT-OF-WAY FOR TELECOMMUNICATIONS INFRASTRUCTURE

As private telecommunications companies seek space to extend fiber optics (FO) networks, and government agencies seek to establish communications networks for Intelligent Transportation Systems (ITS) and other governmental functions, there should be increased opportunity for sharing the public resource of highway right-of-way (ROW) and private resource of telecommunications expertise to further both public sector and private corporate objectives. With that in mind, this paper identifies the nontechnical -- legal and institutional -- issues related to such shared resource projects. This paper does not focus on technical issues of design, installation or maintenance of communications technologies in highway ROW but, instead, on issues of the following nature: Threshold legal and political issues, which must be addressed before proceeding further with shared resource projects; Financial issues, which shape the basic format and orientation of the project; and Project structure and contract issues, which determine the precise arrangement concluded.
