GUIDANCE ON DECRIMINALISED PARKING ENFORCEMENT OUTSIDE LONDON

This document provides guidance on decriminalised parking enforcement for local authorities in England and Wales outside London. It aims to: (1) inform these local authorities about their scope to set up and operate a decriminalised parking enforcement regime, under the provisions of the Road Traffic Act 1991; (2) advise them on how to apply to the Secretary of State for Transport in England, or the Secretary of State for Wales in Wales, for the necessary powers; and (3) advise them on how to set up and operate an effective and efficient decriminalised enforcement regime. The document has six parts, to: (1) explain the powers available to local authorities, and put them in context; (2) advise local authorities on the steps to be taken in preparing their applications; (3) explain what resources local authorities will need to enforce decriminalised parking; (4) describe the procedure for collecting payment of a penalty charge; (5) state the requirements for designation order applications and the arrangements for processing them; and (6) discuss what types of contracts local authorities might use and explain the relevant compulsory competitive tendering arrangements.
