ROAD CONTRACTOR LIABILITY WARNING DEVICES
A case is reported where a highway contractor was found negligent for failing to give adequate warning to a couple injured in an automobile accident, of a dangerous condition of a highway exit ramp. It was decided by the appellate court that the road contractor has the primary duty to exercise reasonable care for the safety of the general public using a road or highway during improvements or repair. The contractor's liability in this respect existed regardless of the requirements of the contract with the public liability on the part of the governmental authority employing a road contractor. The Missouri appellate court ruled that, the court was correct to refuse to allow the contractor to demonstrate to the jury that the ramp was constructed in compliance with Missouri Highway Department specifications and that the Department's engineer had supervised all work.
