RETHINKING RIGHT-OF-WAY ACQUISITION
Partial takings are at the core of a study being conducted by the Texas Department of Transportation (TxDOT) on reducing right-of-way expenditures. A partial taking refers to the purchase of a portion of a property by the state that leaves property owners with uneconomic remainder parcels. This article reports that size, shape, and land use are the most important physical characteristics of remainders that affect right-of-way costs. TxDOT hopes to pass legislation, based on the findings, that would give them the authority to purchase excess right-of-way when improvements cause the creation of small, odd-shaped remainders of low value.
