IN THE WAKE OF THE EXXON VALDEZ - THE OIL POLLUTION ACT OF 1990 - AN ANALYSIS

For fourteen years the United States Congress has wrestled with the problem of unifying the ever-more complex system of United States laws bearing on cleaning up oil spills that occur in the United States of America and compensating parties for the damages they have suffered as a result of these spills. Prior to the EXXON VALDEZ incident, enactment of a comprehensive oil spill liability and compensation statute by the United States Congress was an unlikely development. Issues like federal pre-emption of the individual states' local oil pollution programs was an insurmountable obstacle to consensus legislation. The EXXON VALDEZ incident has changed all that.
