STATUTORY CROSSWALKS AT T INTERSECTIONS

During 1973 there were 279 pedestrian-car accidents in Idaho. Some of these occurred at intersections. Pedestrians are protected by law at intersections because statutory crosswalks are presumed to exist. However, if the language of the Idaho statute is interpreted literally, the pedestrian is protected at a four way intersection but not at a T intersection. The courts have interpreted the statute this way in Idaho and Utah thus denying the pedestrian legal protection. The author calls for a logical interpretation of the statute rather than a literal one, say the legislature meant to protect all pedestrians by providing that statutory crosswalks exist at all intersections and just certain types.
