AN EMPIRICAL STUDY OF FACT-FINDERS IN HIGHWAY CONDEMNATION CASES

In highway condemnation cases awards are made by judges, commissions, or juries depending on the state. The author studied cases by each means of fact finding to see what the variation was. To compensate for varying factors such as state size, property variations etc, the study concentrated on states with two layered systems; where a preliminary, award usually by commissions, could be appealed to a court. 1,769 interstate highway cases where examined. It was found that the variations in decisions between judges, commissioners and juries were insignificant. If there is to be a choice in condemnation cases, factors such as cost and time are more important than who decides.
