PROGRAMMING AND FINANCING OF RIGHT-OF-WAY FOR ADVANCE ACQUISITION
The hearings procedure is discussed, certain definitions are identified, and the advance acquisition of total takings, hardship cases and protective buying are reviewed. The state may reqest and receive approval to acquire total takes, hardship cases and protective buying temporarily from state funds. Reimbursement of the State's pro rate share is withheld until such time as the project is put under agreement obligating Federal funds. Under this procedure, approvals for total takings may be authorized by the Division Engineer subsequent to the holding of the corridor hearing. Procedures relating to protective buying cases involving whole or partial takings and hardship cases involving whole or partial takings are totaling 7.5 million dollars is described.
