CIVIL PENALTIES FOR VIOLATION OF OIL POLLUTION PREVENTION REGULATIONS: INTERIM REGULATIONS
The regulations are applicable to owners and operators of facilities with a potential for discharging harmful quantities of oil into navigable waters. The regulations establish the procedures for the EPA to impose civil penalties for violations of EPA's Oil Pollution Prevention Regulations and include provisions for issuance of violation notices, requests for a hearing on the violation, the appointment of a presiding hearing officer, conduct of the hearing, and penalty appeal procedures. For refusing or failing to comply with any of the provisions, the owners or operators of the polluting facilities may be assessed a civil penalty of not more than $5,000/d of the violation.
