HOW JUDGES SENTENCE DUI OFFENDERS: AN EXPERIMENTAL STUDY
The impact of a driving under the influence offender's blood alcohol content (BAC) at the time of arrest and the number of prior drunken-driving convictions on judges' sentencing patterns were examined. Vignettes were presented to all 170 judges who sentenced drunken drivers in Colorado and they were asked to determine appropriate amounts of jail time, fines, public service hours, and alcohol education course work. Judges sentenced offenders with prior records and with higher BACs more severely. The effects of prior record were generally stronger.
