STATE OF VERMONT V. BRINEGAR, 379 F. SUPP. 606
If a state does not compensate the owners of advertising signs removed pursuant to the highway Beautification Act the Secratary of Transportation may withhold ten percent of federal aid highway funds for that state. Vermont contended that there is no textural nexus between controlling and compensation and that the act is unconstitutional. The court held that the legislative history showed that the ten percent reduction was mandatory and also the only vehicle to enduce state's to meet the act's standards.
