This paper discusses CERCLA (Superfund), the federally-administered program designed to clean up hazardous substance disposal sites ("facilities") caused primarily by past acts of waste disposal, or those caused by current acts of disposal which might be harmful to human health and the environment, and which will not be adequately cleaned up by the responsible parties. Topics addressed include fund-financed cleanup and cost recovery; Federal lien; private party cleanups; administrative order penalties and damages; standard of liability under CERCLA; settlement procedures; use of "mixed funding"; citizens' suits under CERCLA; defenses to liability under CERCLA; "The Innocent Landowner" defenses; and emergency planning and community right to know.
