BLOOD ALCOHOL LEVELS FOR DRIVERS, WITH EVIDENCE. SELECT COMMITTEE ON THE EUROPEAN COMMUNITIES 18TH REPORT. SESSION 1988-89. HOUSE OF LORDS PAPER HL
The select committee is reporting on the European community's draft directive relating to the maximum permitted blood alcohol concentration for vehicle drivers' (4252/89(com(88)707 final)), which proposes that member states should set their permitted blood alcohol concentration (BAC) at 0.50mg/ml as from 1 Jan 1993. There are 2 main areas of debate within the eec on this proposal: a) whether this is an appropriate area for community legislation, and b) the soundness or otherwise of the proposed BAC limit of 0.50mg/ml. At present all member states have a limit of 0.80mg/ml except Portugal and Netherlands where the limit is 0.50mg/ml. Written responses to the committee on the BAC limit, enforcement and education are printed in full from the Department of Transport, the royal college of nursing (rcn), the parliamentary advisory council for transport safety (pacts), and British medical association (bma), the association of chief police officers (acpo), and the economic and social committee of the European communities. Pacts and the rcn are in favour of lowering the limit to 0.50mg/ml; the other bodies and the select committee are against it. The committee recommends the report to the house for information, but proposes that if a reduction in BAC is considered desirable at community level this should be achieved by means of a resolution of member states, and that member states should consider how best to enforce existing limits rather than reduce the limit to 0.50mg/ml.
