MEDIATING DISPUTES: LAND DEVELOPMENT AND CONSTRUCTION
A definition is given of the terms 'mediation' and 'mediator,' and salient features of the mediation process are discussed. It is expected that mediation will play an increasing and important role in resolving a majority of disuputes and potential disputes. Civil Engineers are advised to be aware of the nature of mediation as a method of voluntary alternative dispute resolution. Engineers should encourage the inorporation of the mediation process as a step before consideration of litigation in agreements for design services and construction contracts. Civil engineers are encouraged to consider a period of service as a mediator. Engineers, throughout their professional careers, should foster good risk management practices and prevention of disputes.
