IMPACT OF PROFESSIONAL PRACTICE STANDARDS ON LIABILITY OF ENGINEERS

The potential impact of professional practice and standards of conduct upon the liability of engineers are examined in this paper. The paper focuses on two issues: to what extent may professional practice standards promulgated by professional associations be utilized by courts in determining whether to impose civil liability; and to what extent may findings rulings or other determinations of a state registration board affect the determination of the civil liability of that engineer for claims arising out of the same circumstance involved in the board's proceeding. Conclusions drawn from a consideration of the issues are discussed.
