REVIEW OF CERTAIN ACQUISITIONS OF VOTING SECURITIES OF AIR CARRIERS. REPORT TOGETHER WITH DISSENTING VIEWS TO ACCOMPANY H.R. 3443, COMMITTEE ON PUBLIC WORKS AND TRANSPORTATION, HOUSE OF REPRESENTATIVES, 101ST CONGRESS, 1ST SESSION

The Committee on Public Works and Transportation, to whom was referred the bill (H.R. 3443) to amend the Federal Aviation Act of 1958 to provide for review of certain acquisitions of voting securities of air carriers, and for other purposes, having considered the same, report favorably thereon with an amendment and recommend that the bill as amended do pass. The reported bill, H.R. 3443, will enhance the powers of the Secretary of Transportation to deal with issues of vital importance to the aviation industry; acquisitions of control of United States airlines involving leveraged buyouts and increased foreign ownership and control. The bill establishes procedures to ensure that there will be a reasonable opportunity for the Department of Transportation to review acquisition proposals before they are completed. The bill also gives the Department authority to disapprove those proposals which would impair an airline's ability to provide safe, reliable and effective service or which would give foreign interests the power to control a United States airline. The bill will not prevent legitimate acquisitions which would not impair the safety or competitive effectiveness of the acquired airline.
