ACQUISITION OF CERTAIN RAILROADS. HEARING BEFORE THE SUBCOMMITTEE ON SURFACE TRANSPORTATION, COMMITTEE ON COMMERCE, SCIENCE, AND TRANSPORTATION, ON S. 1005, UNITED STATES SENATAE, 101ST CONGRESS, 1ST SESSION, JUNE 22, 1989

This is a hearing on S. 1005, a bill relating to the sale, purchase, or other acquisition of certain railroads. S. 1005 would give the Interstate Commerce Commission (ICC) jurisdiction over noncarrier acquisitions of Class I rail carriers. The ICC currently has statutory authority to approve transactions in which a rail carrier proposes to acquire another rail carrier and where a person who is not in the rail business proposes to acquire two or more carriers. However, the Interstate Commerce Act does not provide clear jurisdiction in cases where a noncarrier is acquiring a single rail carrier, regardless of the size of the carrier being acquired. S. 1005 seeks to address this by providing the ICC with authority to review all acquisitions of Class I carriers and by establishing a public interest test for their approvel.
