FAILURE TO WARN OF CURVE MAKES LOUISIANA LIABLE FOR HIGHWAY DEATH

A Louisiana Court of Appeal recently affirmed a District Court judgment which found the State 100% at fault for the death of an eighteen year-old man whose car failed to negotiate a curve and ran into a bridge abutment. In the same judgment, the Court of Appeal also addressed an identical suit brought by the three passengers in the car at the time of the accident. Details of the accident are presented in this article. (Moreau v. State Through DOTD 87-418 (527 So.2d 1221 La. App. 3 Cir 1988))
