PROCUREMENT OF NEW PASSENGER RAIL CARS FROM JAPAN

In May 1983, the California Department of Transportation (CALTRANS) signed a contract with Sumitomo Corporation of America, in which Sumitomo agreed to furnish 63 new stainless steel gallery type passenger rail cars. Caltrans utilized the new cars in the Peninsula Commute Service operated by the Southern Pacific Transportation Company between San Francisco and San Jose, California. Sumitomo contracted with Nippon Sharyo Seizo Kaisha Limited, one of the largest rail car manufacturers in Japan, to construct the new cars. The stainless steel carbody shell was constructed in Japan, and was then shipped to San Francisco for outfitting and installation of equipment to complete the car. This paper details some of the challenges that have confronted Caltrans and the carbuilder in administering this contract. In particular, the methods used to coordinate with a foreign contractor, handle contract change orders, and handle Buy-America requirements are explained.
