TOWARD RESPONSIBLE SHIPBUILDING
Shipbuilding has come a long way from the handshake between the builder and owner which sufficed as a contract many years ago. Current contracts seem more intent on protecting each party's potential liabilities rather than assigning their responsibilities. This paper proposes some reassignment of responsibilities among the shipbuilding participants, and definitive contracts, plans, and specifications such that litigation can be avoided. While the roles of many shipbuilding participants are discussed, the paper's chief objective is to show that the legal and accounting roles should be one of support--not primary--since the object of the contract, plans, and specifications is to build a ship.
