A REVIEW OF EMERGING ALTERNATIVES TO RESOLVING DISPUTES OTHER THAN BY LITIGATION - WHERE DOES THE "PRACTICE OF LAW" BEGIN? PAPER PRESENTED AT THE 27TH ANNUAL WORKSHOP ON TRANSPORTATION LAW, STAMFORD, CONNECTICUT, JULY 24-28, 1988
The most significant new trend affecting the legal profession is the use of Alternative Dispute Resolution (ADR) in place of litigation. While certain forms of ADR, such as arbitration, have been around for decades, the new emphasis on ADR in the eighties is a child of necessity brought about by the crushing case load in both state and federal court systems. This paper presents a review of emerging ADR procedures now in common usage. It concludes with comments on the protection of confidentiality of statements made during ADR.
