AUDIT COMMISSION REVIEW. SEPTEMBER 1987: IMPROVING HIGHWAYS AGENCY ARRANGEMENTS BETWEEN COUNTIES AND DISTRICTS. AN INTERIM REPORT
This paper presents a critical review of the current arrangements for managing local authority roads in England and Wales, with special reference to the roles and interaction of county councils and district councils. The paper proposes that Section 42 of the Highways Act 1980 should be repealed and substituted by a statutory duty on counties to consult their districts on highway policy matters, whilst the County Council remains ultimately responsible for highways. To this end it is suggested that: (1) counties should review existing agency arrangements in consultation with their districts; (2) highway maintenance agency should be a contractual arrangement; and (3) district council members should not get involved in the day to day management of current year service provision.
