TENNESSEE COUNTY FOUND LIABLE FOR DEFECTIVE DRAINAGE CULVERT WHICH COLLAPSED DURING RAIN STORM
A Tennessee Appeals Court affirmed a circuit court decision which awarded damages to a motorist and passenger who were injured when their car fell into a collapsed culvert during a rain storm. The Appeals Court examined the evidence which went back as far as 2 years. The testimony of an expert witness is presented, and it is shown how the Appeals Court agreed with the circuit court in finding that the evidence showed the culvert was defectively constructed and that the previous washout of the culvert (2 years ago) was sufficient to put the county on notice of a defective condition.
