NEW MEXICO CIRCUIT COURT FINDS HIGHWAY DEPARTMENT LIABLE FOR SHOULDER DROP-OFF AND LACK OF STRIPING IN WORK ZONE DEATH
A New Mexico Circuit Court found that the State Department of Transportation was negligent in the death of a motorcyclist struck and killed by tractor trailer on Interstate 40. The circumstances of the accident are described, as well as the expert testimony presented in court. It is noted that interim shoulder striping was not provided as discussed and agreed to at the pre-construction conference to eliminate confusion to the traveling public as to lane location.
