LOUISIANA PEDESTRIAN AWARDED $107,000 FOR FALL ON STATE ROAD
A Louisiana Court of Appeal affirmed a lower court award to a pedestrian who tripped over an exposed reinforcement rod on a state-maintained road and injured his back. The trial judge made an itemized award to the pedestrian totaling $100,159 and to his wife, $7,500 for loss of consortium. The Louisiana Department of Transportation and Development argued that the awards were excessive. The issue for the Court of Appeal was to determine whether the trial judge abused his discretion in making the award he did. On all points, the higher court found no abuse, even though the plaintiff had a history of back problems.
