This panel which explored the shipper perspectives on recent developments in railroad competition, focused on (1) rate reasonableness; and (2) joint rates and competitive access. Remarks by various speakers are presented which relate to reglatory proceedings on rail competition issues, and the Midtech Paper Corporation versus Chicago and Northwestern, where Midtech sought competitive access relief and in particular sought remedy through trackage rights. Another speaker remarked on the Staggers Act and the National Transportation Policy. Another speaker's comments focused on West Virginia's innovative and creative trackage access bill. The focus of the discussion was on the pros and cons of government intervention to assure reasonable rates or competitive access.
