ABSENCE OF "DEER CROSSING" SIGN NOT HELD AGAINST STATE
A Court of Appeals in New York dismissed a claim of negligence against the State for its failure to post a deer warning sign. The case involved injury in a 2-car accident proximately caused by deer on the highway. Testimony was presented that the safe speed for negotiating the curve was 40 mph although 55 mph was prescribed in a speed sign. However, another sign warned that the road curved to the right. It was therefore found that this did not necessitate a sign advising a speed of 40 mph. It was also found that the highway construction and the lack of additional warning signs did not proximately cause or contribute to the accident.
