BULK CARRIER CONFERENCE SEMINAR. THE HAZARDS OF HAZARDOUS MATERIALS TRANSPORTATION

This conference focused on the extent of the problem of liability facing both carriers and shippers, the methods of reducing liability, and issues involved in pricing transportation services in light of the increased liability. This article discusses a carrier's liability, what the potential for exposure to such liability is, and how to attempt to account for such liability in pricing service. Three cases are described to illustrate the circumstances of liability for which carriers of hazardous materials are exposed, and recommendations are made as to how such circumstances may be avoided. In the first case, the shipper was found to be negligent because of improper documentation, and the carrier was found to have been negligent because it had reason to know that the shipping papers had been improperly prepared. In another case, the negligence identified by the state courts on the part of the carrier was allowing the carrier's identification devices to fall into the hands of a person who could unlawfully "sell" them to an illegal operator.
