ENFORCEMENT OF NOISE STANDARDS: AN OVERVIEW OF PROBLEMS, STRATEGIES AND SOLUTIONS
The purpose of this paper is to evaluate the legal tools available to an agency which is charged with the enforcement of noise standards. The basis for the paper is the experience of the Pennsylvania Department of Environmental Resources; and the yardstick of evaluation is the extent to which a given legal tool achieves compliance with the law and abatement of noise, rather than punishment or retribution. The first section of the paper discusses the threshold problems of designing valid regulations, collecting evidence (monitoring), and setting priorities, and the second section analyzes the various enforcement tools. Two fundamental issues are considered: devising technological solutions and choosing enforcement solutions.
