Acquisition of Utility Property Interests and Compensation Practices for Utility Relocations

When a transportation construction project involves the relocation of utility facilities, a state department of transportation (DOT) must engage in complex negotiations with utility owners and other property owners. These negotiations frequently involve the acquisition of existing utility property interests, acquisition of replacement properties to facilitate the relocation of utility facilities, and relocation or adjustment of these facilities. This process is subject to federal and state laws and regulations as well as agency and utility owner business practices. Agencies differ in their practices for the acquisition of utility property interests and how they reimburse utility owners for relocations. Anecdotal evidence suggests that these practices have an impact on the acquisition of right-of-way for the project, utility relocations, and the overall project delivery process. However, systematic research had not been completed to assess practices. To address this need, NCHRP Project 11-08, “Guide to Acquire Utility Property Interests and Reimburse Utility Relocation Costs,” (a) documented laws and regulations, agency policies, and project delivery procedures that agencies use to acquire utility property interests and compensate for utility relocations; and (b) developed guidance that DOTs and others can use to enhance the effectiveness of their own practices. This report summarizes research activities, lessons learned, and recommendations for implementation. The report is organized as follows: Chapter 1 briefly justifies the research and summarizes upcoming chapters. Chapter 2 summarizes relevant federal and state laws and regulations. Chapter 3 describes practices related to the acquisition of utility property interests and utility relocation reimbursements. Chapter 4 includes a sample of case studies for specific topics of interest. Chapter 5 includes conclusions and suggested research.
