STARTING-POINTS FOR TRANSPORT LEGISLATION. A BASIS FOR A COHERENT POLICY

The transport policy of the Dutch government is almost fully controlled by legislation focused on regulation of supply and demand within the different transport sections. Through a controlled capacity on the part of the supplier of transport influence is exercised on the pricing of transport performances. In this way the transporters are also protected. With road transport this happens by not giving access to the transport market to new companies unless they have a carrying licence. Also expansion of existing companies is limited. Within water transport a large part of the transport supply is distributed via an exchange system in rotation. The present regulations are not only very detailed but also very uncoordinated and they have not led to the goal intended. In this article the author points out a possibility of dealing with transport interests in another way from the point of view of the government. When a policy is being developed the legal framework must be looked at first. In this context international treaties, especially the common market treaty and its underlying principles, offer binding regulations for national governments. (TRRL)
