CONTRACTOR VIOLATES CONTRACT WITH STATE, LIABILITY LEADS TO $2 MILLION SETTLEMENT
When an independent contractor violates contract specifications while resurfacing an interstate highway in Connecticut, a lawsuit brought after a serious accident cost the contractor approximately $1.7 Million. A van had lost control in construction zone I-86 when it encountered a drop off between the pavement and the gravel shoulder. The driver was left guadriplegic as a result of the accident. The contractor had been required to provide a gravel recovery area adjacent to and level with the shoulder when that portion of the road was being used as a travel lane. Witnesses testified that a drop off varying between two and seven inches existed between the newly paved shoulder and the gravel areas.
