THE NEW OUI AND HABITUAL OFFENDER PROVISIONS
This report is intended to familiarize law enforcement officers of the state of Maine with differences between the old law and the new law they should know about which affect the arrest, blood alcohol testing and early prosecution stages. It contains: 1) Operating under the influence and operating with a blood alcohol level in excess of .10 (Stopping, Arrest and blood alcohol test stages; obtaining blood-alcohol tests, "refusals"; charging, first appearance, test results) and 2) New provisions concerning operation of suspensions and the habitual offender law.
