CONNECTICUT'S PROCEDURE FOR RESOLVING CONSTRUCTION CONTRACT DISPUTES
The Connecticut Department of Transportation has a Contract Board of Review. That board was established in 1966 and has functioned continuously since then. The purpose of the Contract Board of Review is to consider appeals by contractors and render final decisions for the Department of Transportation on all matters governed by construction contracts. The board does not consider matters beyond the terms of the contracts, such as claims of breach of contract or other matters of equity. The board consists of five voting members from various sectors of the department. The present makeup is Specifications, Design, Finance, Soils, and Aeronautics. In addition, there is a nonvoting designee from the office of construction andd a nonvoting secretary. We have available two alternates who substitutes for voting members that are not available. In addition, the Transportation Counsel is available at the request of the chairman for advice to the board. To insure that only appeals to previously rendered decisions are considered, matters may only be brought to the board through the district engineer administering the contract. The request will forwarded through the Chief of Construction and Director of Construction to the chairman. Over the years, the board had proved to be very worthwhile. It appears to have virtually eliminated individual appeals to the commissioner to review previously made decisions and has definitely reduced the number of problems going to litigation. On many occasions, even when a contractor receives a decision which is not favorable, he is satisfied that a fair review has been made. (Author)
