ALABAMA'S PROCEDURE FOR RESOLVING CONSTRUCTION CONTRACT DISPUTES-CONTRACTOR CLAIM PROCEDURE ALABAMA HIGHWAY DEPARTMENT CONSTRUCTION MANUAL

Where a contractor believes that he is entitled to extra compensation for work or materials not clearly covered in the contract, he may file a claim pursuant to the 1976 Standard Specifications, article 109.10. The following policy has been formulated to facilitate the prompt settlement of such claims. The contractor shall notify the engineer as required in subarticle 109.10)a' prior to beginning work on the disputed item. The division will then forward the claim notice to the construction engineer who will, in turn, notify the members of the claims committee in order that they may visit the site while the disputed work is in progress. As promptly as possible after work on the item in question has been completed, the contractor shall submit to the division engineer eight copies of his completely documented claim. After the division has reviewed the claim and is assured the necessary documentation is complete, in no case later than 30 days after receipt of claim, six copies of the claim, along with the division's recommendations, should be submitted to the construction engineer in Montgomery. When the division and costruction bureau concur in the validity of the claim, it may be settled as this point; otherwise, the construction engineer will distribute the claim to members of the claims committee for their review and schedule a meeting with the contractor within 30 days.
